ORGANIZATION OF THE AWARD

1. The official name of the award is UNITY Mark – Award for Content that Inspires and Promotes Unity, Reconciliation and Dialogue (hereinafter referred to as “Award”). The abbreviated name of the award is UNITY Mark Award, together with the year for which the individual awards are given. UNITY Mark Award 2022 is an award for projects carried out between January 2019 and December 2022.

2. The purpose of the award is to prize individuals, organizations, media companies and enterprises from around the globe who have created either campaigns, online and print content or newsletters (further “activities”) that positively impact a united world in their localities or regions. They deserve and we want them to be known, heard and appreciated, amplifying in this way even more not only their impact, but the synergy of a network of communicators and media actors for good. We are searching for individuals and organizations that are making constant efforts to create and spread content that inspires and promotes unity, reconciliation and dialogue.z3. The Nuova Global Foundation (hereinafter referred to as “the Organizer”) is the announcer and Organizer of the award. For the purpose of the award management the organizer nominates the Award Committee.z4. On the day of the announcement of the award, the Organizer publishes on its website nuovaglobal.org all relevant information, including the announcement of the award categories for 2022, the method, scope and form of sending nominations, the time within which nominations can be sent to the Organizer, the timetable – from the moment of the announcement of the award to the official awarding of the UNITY Mark Award 2022, and any other organizational issues related to the nomination or award process.

5. In each year of the award, the Organizer awards prizes to one nominated entity or a group of nominated entities in the announced categories, based on the decision of an independent Evaluation Committee, i.e. the jury. Outside the decision of the committee, the Organizer himself may only award the Public Prize.

6. For 2022, this award shall be given to individuals, non-profit organizations, media companies and enterprises who have created either campaigns, online and print content, newsletters, videos, podcasts, video games or interactive challenges (further “project/projects”) that positively impact a united world in their localities or regions, in the following categories: 

    • Category 1) Public Awareness Campaigns
    • Category 2) Online or Print Content / Newsletters
    • Category 3) Videos or Podcasts
    • Category 4) Video Games, Apps and Interactive Challenges.

Besides this, a public voting will be effectuated.

    PARTICIPATION

    7. Only business entities, non-profits or individuals that have not been legally convicted in the past three years in connection with their business activities can be nominated for the award.

    8. Nominations in all categories shall be submitted by the applicant or by groups of entities that meet the conditions defined by the Organizer, on their own behalf. If the nomination concerns a joint project with an NGO or other partner, the application form must also include the project partner’s agreement to the content of the nomination.z9. Nominations shall be submitted via the electronic nomination sheet for the relevant category. The nomination sheets, including information regarding its completion and submission, are published by the Organizer together with other relevant information on the day of the award announcement. The applicant shall submit the completed nomination form by 30 December 2022, 23:59 midnight Central European Time, by filling in the electronic form on the website nuovaglobal.org. The award Organizer will send an email to the applicant confirming receipt and inclusion of the nomination in the evaluation process. If the applicant does not receive an email from the Organizer within 2 working days confirming the acceptance of the nomination, the Organizer must be contacted immediately. Otherwise, the nomination is considered undelivered.

    10. For the purposes of nominations for the award, a small-medium enterprise is defined as one with an annual sales turnover of US$3M and below.

    11. An applicant may not nominate a project in more than one category. The Organizer is entitled to recommend a nominated project for another category if it is of the opinion that the project in question is more appropriate in terms of its prerequisites to be placed in another category. The Organizer is obliged to inform the applicant of such a fact in the notification of the inclusion of the nomination in the evaluation process. If the Applicant does not notify the Organizer of his/her disagreement with the reassignment to another category within 2 days of the date of receipt of the notification of the inclusion of the nomination, it is assumed that he/she agrees to the reassignment to the category recommended by the Organizer.

    12. Only nominations meeting the basic requirements set out in the nomination sheet and received by the closing date will be included in the judging process. Nomination sheets received by the closing date will be checked by the Organizer to ensure that they meet the basic formal and substantive requirements. Within 7 days of the deadline, the Organizer will inform the Applicants by e-mail whether or not the nomination will be included in the evaluation process, or request additional information necessary for the evaluation.

    13. Nomination sheets received after the deadline or that do not meet the basic requirements (which are the nomination of an eligible entity under this Statute, a fully completed nomination sheet and essential identification and content information, submission of the nomination in electronic form) will not be included in the evaluation process. The Organizer shall inform the Applicant of this fact by e-mail.

    14. Nomination sheets from partners/sponsors of the award (regardless of whether such nomination is received from a partner or a third party) are also excluded from the evaluation process.

    15. An individual, non-profit organization, media company or enterprise that has previously won the award in one category may not apply in the same award category in the following two years but may be nominated in the other award categories.

    16. A project that has previously won the award in one of the categories may not be nominated for the award again.

    OBLIGATION OF APPLICANT

    17. Applicants are required to fulfil the following prerequisites in order to participate in the UNITY Mark Award:

    • Provision of entry submissions, documentation and any related materials as requested by the Evaluation Committee for online, physical and on-site screenings
    • Consent and provision of any additional information for promotional and marketing activities, especially in case the entry should be awarded the UNITY Mark
    • Allow the winning entry to be exhibited during stipulated dates decided by the Organizer
    • Eventual cost of transportation, installation and dismantlement of project to and from the judging venue and/or exhibition to be borne by award winners
    • Payment of all submission and award-winner package fees (inclusive of transactional charges) by the stipulated dates.

    UNITY MARK APPLICATION WITHDRAWAL

    18. Applicants who wish to withdraw from UNITY Mark may do so before the stipulated submission deadline i.e. Applicants who withdraw must notify the Organizer via email at info@nuovaglobal.org, along with the reason for withdrawal. Submission fees are not refunded.

    19. Unless marked with [ND which stands for Non-Disclosure], the Organizer has the prerogative to disclose any and/or all information provided by the participants during online submissions. The Organizer and the Evaluation Committee are obliged to adhere strictly to the code of confidentiality for non-disclosed information which will be used in consideration for UNITY Mark screening purposes only.

    DISCLOSURE OF INFORMATION

    20. The UNITY Mark advocates the engagement of the general public step-by-step in order to deepen their understanding of how content that inspires and promotes unity, reconciliation and dialogue can be designed. This involves disseminating relevant information about the entries throughout the entire judging process, as well as featuring the projects on our websites, exhibitions, conferences, press and marketing materials, etc. that are available to the public.

    21. Unless marked with [ND which stands for Non-Disclosure], the Organizer has the prerogative to disclose any and/or all information provided by the participants during online submissions. The Organizer and the Evaluation Committee are obliged to adhere strictly to the code of confidentiality for non-disclosed information which will be used in consideration for UNITY Mark screening purposes only.

    PERMISSION TO USE AND MODIFY INFORMATION

    22. Applicants grant Organizer the right to use and potentially modify the information provided to suit the needs of promotional and marketing activities, as well as during the screenings and the above-mentioned disclosure of information to the general public. The Organizer is not required to show applicants the amended copy or information before disclosure to the general public.

    EVALUATION PROCESS

    23. The Evaluation Committee is proposed and set up by the award Organizer whereby each category has its own sub-committee. Membership of the Evaluation Committee is honorary and non-representative. The Organizer organizes and attends the meetings of the Evaluation Committee, acting as a discussion coordinator and facilitator of the Evaluation Committee. The Organizer shall also be represented on the panel as a source of additional information, but without voting rights.

    24. The meetings of the Evaluation Committee are closed and information on the discussion as well as on the voting on the individual nominations is considered confidential. The members of the Evaluation Committee undertake to keep information from the nomination sheets and group evaluations confidential.

    25. Information about the winner of the award in the relevant category may only be published by the Organizer on the day of the announcement of the winners, as set out below in article 38 of these Statutes.

    26. The Evaluation Committee shall evaluate the nomination sheets in two rounds, preceded by an individual evaluation. At its first meeting, the panel will decide which nominations will proceed to the final round, creating a shortlist of nominations. At the second meeting, the members of the panel shall select the winner of each category. If consensus cannot be reached on the winner in the respective category, the Evaluation Committee shall decide the winner by a vote, requiring at least a majority of the members of the Evaluation Committee present to reach a decision.

    27. The Evaluation and Award Committee decisions are made with their own discretion and are considered final and unalterable.

    28. The Evaluation Committee has the right to decide not to award any of the prizes if none of the nominations received meet the criteria of the category.

    29. The evaluators, i.e. jurors, through the Organizer, may request additional information on the nomination sheets from the nominated entities. The additional information will then be sent to all members of the Evaluation Committee.

    30. Representatives of the nominated entities for the awards in all categories, who have been selected for the final round on the basis of their individual evaluation, are invited to present their projects in person or online to the Evaluation Committee. The presentations must be made according to the requirements specified by the Organizer. The nominees will receive a summary of the requirements immediately after the shortlists have been created by the Evaluation Committee.

    31. The Organizer reserves the right to amend the regulations, terms and conditions of the award if retained for appropriate.

    CONFLICT OF INTERESTS

    32. A member of the Evaluation Committee may not vote for or evaluate an Applicant or his/her project if he/she has such a formal or informal relationship with the Applicant that could influence his/her objective decision-making. It is the duty of the members of the Evaluation Committee to inform the Organizer of such a relationship immediately, but at the latest before the allocation of the nomination sheets for the individual evaluation. A member of the Evaluation Committee cannot be a representative of an Applicant for an award in any category.

     

    DISQUALIFICATION, REVOCATION AND SUSPENSION

    33. The Organizer has the right to disqualify and revoke the UNITY Mark from an awarded entry should any of the following occur:

    • Serious violation of applicable law, the principles of responsible business conduct or these Statutes
    • Failure to make timely payment of submission and winners package fees by the stipulated deadline.
    • The awarded entry is publicly recognised as having infringed the intellectual property rights of another party.
    • The awarded entry has not adhered to the specifications stipulated in the UNITY Mark Usage Guide without the written consent of the Organizer.

    34. Disqualification and revocation will result in a public renouncement of the entry and its subsequent removal from the website and all future collateral.

    RELEASE OF RESULTS

    35. Within two weeks after the closing date, the Organizer will publish on its website nuovaglobal.org a list of the nomination sheets received and included in the evaluation process.

    36. Within two weeks after the creation of the shortlist, the Organizer will publish it on its website nuovaglobal.org.

    37. Any request for the disclosure of individual screening results before the official announcement will be denied.

    38. Winning positions for each Category will be:

    • announced after the conclusion of the evaluation process expectedly in March-April 2023,
    • solemnly awarded at the UNITY Conference in June 2023,
    • and subsequently released on the Organizer’s website and other marketing and communication platforms.

    39. A delay in the announcement of the results by the Organizer may happen should it be necessary in the event of unforeseen circumstances e.g. natural disasters/terror acts/death of key member of Organizer, etc.

    40. The Award Committee of the Organizer reserves the right not to confer awards in any category if the entries were found to be below par in terms of reaching the top bandwidth of a category’s scoreboard.

    PROTECTION OF INTELLECTUAL PROPERTY (IP) RIGHTS

    41. Usage of Personal and Corporate Information: The utilization of both private and corporate information provided by Applicants shall be limited to what is necessary in order to operate UNITY Mark’s awarding system. It is hereby stipulated and agreed upon by and between the Organizer and the Applicants that this information has received the consent of the Applicant(s), author(s) and client(s) for this purpose.

    42. Usage of Information of Successful Applications: All Applicants reserve the copyrights to the information and related materials provided for the entries submitted, of which usage by the Organizer shall be limited to the extent necessary to the screening process and public release. It is hereby stipulated and agreed upon by, between the Organizer and the Applicants, that this information has received the consent of the Applicant(s), author(s) and client(s) for this purpose.

    43. With regard to entries awarded with the UNITY Mark, the Organizer hereby stipulates permission to the usage of the information provided for publication on all relevant publicity materials including but not limited to media coverage, winners’ announcement ad, website, exhibition and in the winners’ directory, the extent necessary for other promotional activities of the Mark and to reasonable modifications made under unavoidable instances concerning purpose and formatting.     DECLARATION OF INTELLECTUAL PROPERTY RIGHTS

    Indemnity Clause

    44. Applicant covenants and agrees to hold Nuova Global Foundation (NGF); the Organizers, operators, and managers of UNITY Mark and the respective officers, agents, collaborators, partners and employees of each (hereafter collectively referred to as “UNITY Mark Management Team“) harmless from any and all claims of liability, damage, intellectual property infringement or expense arising from any injury to or death of any person, including the registrant’s employees, agents, or contractors or any loss of, damage to, or theft of any property, including the Applicant’s.

    45. An omission of Applicant includes any failure of Applicant to comply with any of the terms and conditions of this Agreement; any rules and regulations of UNITY Mark; and any laws of the Kingdom of Spain. Applicant agrees to indemnify all members of the UNITY Mark Management Team any and all expenses, attorneys’ fees, and any judgements awarded or settlement amounts agreed to. Applicant also agrees that UNITY Mark Management Team is not responsible for any loss, damage, or theft of or to any property of anyone, including the Applicant and its employees, agents or contractors, while in transit to or from the venue space, while in the venue space or otherwise.

    46. The Organizer shall bear no liability concerning any disputes and conflict arising between the Applicant and other third parties in connection with the application for or receipt of UNITY Mark.

    OTHER TERMS AND CONDITIONS

    47. The Organizer reserves the right to modify these Statutes at its sole discretion.

     These Terms and Conditions shall enter into force on 31 August 2022.
